Phoenix Attitude Inc. (“Phoenix Attitude” or “We”) is committed to protecting your privacy and the confidentiality of the personal information that you input and store in our web-based Medical & Motivation service (the “Website”). Through the Website, we offer our users (which includes “you”) a secure, online tool to manage your own personal health information.

This Privacy Statement sets out the way in which we collect, use, disclose and otherwise manage your personal information.

Guiding Principles

We built the Website using the concept of Privacy by Design, which is a universally accepted international standard for privacy protection. It is based on the following seven foundational privacy principles that focus on proactively building privacy directly into our Website and our business practices:

We collect personal information that you provide to us when you use our Website, including when you participate in the following activities:

  1. Register and pay for use of our Website to store your personal health information and share such information with others;
  2. Sign up to receive our newsletter or other marketing emails;
  3. Communicate with us by e-mail or otherwise with a comment or question.

Registration & Website Use: When you register on our Website, we collect your name, email address, and a password that you select, and we will provide you with a unique PIN. We use this registration information to provide you with an account and to administer your account. We also collect your credit card information to process your payment. We will only use the credit card information you provide us once. If you want to create multiple accounts or purchase products through our website, you will need to enter your credit card information each and every time – for maximum protection.

You can use our Website to store and share personal health information. For example you can choose to provide your medications (such as dosage and frequency), side effects, allergies, medical conditions, surgeries/procedures, doctors and information relating to your appointments, such as when, where and whom they are with, their purpose, what they will involve, your thoughts and concerns, your notes afterwards and any audio and/or video recordings you may make during the appointments with the permission of any person recorded.

You may also choose to provide us with the name and email address of an “ICE” – “In Case of Emergency – contact or other friend or family member. We will only use their name and email address to allow them to access your account or information, in accordance with your preferences.

Newsletter: We may also collect your email address to send you our newsletter or other marketing emails - IF, and only if, you give us your express permission. We give you the choice to opt-out from receiving any future newsletters or other marketing from us by clicking the unsubscribe link in any of our emails. We may also use your email address to provide you with notification information and updates about your account.

Customer Service: If you choose to e-mail or contact us with a comment, suggestion or feedback, we collect your name, e-mail address and the comments, suggestions or feedback you provide. We may keep this information to help you in the future. We also may use your comments, suggestions or feedback to monitor and/or improve our Website.

Sharing of Personal Information

Access to your personal information on the Website is permission-based. We give you the power to share your information with others, including your ICE contact or other family and friends, by granting them “read-only” access. In other words, they can’t change anything, they can only read what you share with them. You can see who has accessed your information and revoke these access privileges at any time through the dashboard.

Service Providers: We may need to transfer (or otherwise make available) your personal information to third parties who provide services on our behalf. For example, we may use service providers to process payments or host this Website. Our service providers are located in Canada or the US. All of our service providers are required to maintain the confidentiality and security of your personal information, and are prohibited from using or disclosing your personal information for any purpose other than providing the services on our behalf or as otherwise required by law. In general, you can visit our Website without submitting any personal information. However, we collect the IP (Internet protocol) addresses of all visitors to our Website and other related information such as page requests, browser type, operating system and average time spent on our Website. We use this information to help us understand our Website activity, and to monitor and improve our Website. Cookies: Our Website use a technology called "cookies". You have the right to access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions that are set out by law.

You can access, update or correct the personal health information you input at any time by logging into your account. You may also request access, updating and corrections of inaccuracies in other personal information we may have about you by emailing or writing to us at the contact information below. If you do make these requests, we may ask you to provide us with certain personal information to verify your identity. Safeguards

We use administrative, technical and physical safeguards designed to protect against anyone accessing, using, changing or disclosing personal information in our custody and control.

At the very outset, you must choose a strong password to register for and sign into your account We don’t allow you to use a weak password for your own protection. All information you enter into our Website is encrypted to prevent the information from being read by anyone but you. That includes all files, photos and recordings that you upload to Medical & Motivation.

We strongly recommend that you don’t disclose your password to anyone. If you choose to let someone else access your account (e.g. your ICE contact, or friend or family member), they must use their own username and password. We also really want and ask you to read our Terms of Use so you are familiar with the steps we require you to take to protect your own personal information when using our service.

Retention

Our processes are designed to keep your personal information for no longer than we need to in order to fulfill the purposes stated above or to otherwise meet legal requirements.

If your account is terminated for any reason, we will of course offer you the opportunity to retrieve or transfer your personal information.
